LEASE
DATED 4 JUNE 1809

Indenture being a Lease for a year of a close of land containing thirteen acres
situate in the township of Little Fenton otherwise Fenton Biggin in the parish
of Church Fenton in the County of York dated 4 June 1809, Mr James Swaine
senior to Mr James Swaine junior

This Indenture made the fourth day of June in the year of our Lord one
thousand eight hundred and seven Between James Swaine of Tadcaster in
the county of York Yeoman of the one part and James Swaine the younger of
Tadcaster aforesaid Yeoman of the other part Witnesseth that for and
in consideration of the sum of five shillings of lawful money of Great
Britain by the said James Swaine the younger to the said James Swaine the
elder in hand well and truly paid at or before the sealing and delivery hereof
the receipt whereof is hereby acknowledged He the said James Swaine the elder
Hath bargained and sold and by these presents Doth bargain and
sell unto the said James Swaine the younger his executors administrators and
assigns All that one close of arable meadow or pasture ground formerly
in two closes containing by estimation thirteen acres be the same more or
less situate lying and being in the township of Little Fenton otherwise
Fenton Biggin in the parish of Church Fenton in the said county of York and
formerly in the possession or occupation of Robert Grant afterwards in the
possession of Robert Shaw but now in the tenure or occupation of James Mason
his undertenants or assigns Together with all and singular ways roads
paths passages waters watercourses hedges ditches fences commons common of
pasture and turbary profits privileges liberties advantages emoluments
hereditaments and appurtenances whatsoever to the said close of land
hereditaments and premises hereby granted and released or any part thereof
belonging or in any wise appertaining And the reversion and reversions
remainder and remainders yearly and other rents issues and profits thereof
and of every thereof To have and to hold the said close of land
tenements hereditaments and all and singular other the premises herein above
mentioned and hereby or intended to be hereby bargained and sold with their
and every of their appurtenances unto the said James Swaine the younger his
executors administrators and assigns from the day next before the day of the
date hereof for during and unto the full end and term of one whole year from
thence next ensuing and fully to be complete and ended Yielding and paying
therefore unto the said James Swaine the elder his heirs and assigns the
yearly rent of one pepper corn at the expiration of the said term if the same
shall be lawfully demanded To the intent and purpose that by virtue of
these presents and of the statute made for transferring uses into possession
the said James Swaine the younger may be in the actual possession of the said
tenements hereditaments and premises and be thereby enabled to take and
accept a grant and release of the freehold reversion and inheritance of the
same premises and of every part and parcel thereof to him his heirs and
assigns in and by one Indenture of Release which is intended to bear date the
day next after the day of the date hereof In witness whereof the said
parties to these presents have hereunto set their hands and seals the day and
year first above written
