EDWARD RYCAUT

 

A vellum document being the Probate copy of the Last Will and Testament and Codicil of Lieutenant Colonel Edward Rycaut dated 1763 with the Probate attached reading as follows

Of the Will and Codicil of

Edward Rycaut Esq

 

Will dated 22 June 1763

Testator died 8 July 1763

Will proved 26 July 1763

 

This is the last Will and Testament  of Lt Coll Edwd Rycaut late of His Majesty's Marine Forces being of sound mind and memory do leave and bequeath all my worldly effects as follows first I leave to my wife Marcella Rycaut the sum of twenty pounds and twenty pounds pr annum during her natural life to be paid quarterly the first quarterly payment to begin the day after my decease the rest and residue of my fortune (except a pair diamond earrings which I leave to my eldest daughter Ann Rycaut) I leave to be equally divided between my two daughters Ann and Celia Rycaut or the longest liver Secondly I do by these presents constitute and appoint my dear mother Elizabeth Rycaut of the parish of Heston County Middlesex widow and my dear brother Major Paul Rycaut my sole executors trustees and guardians to my two daughters impowering them to sell or dispose any part of my effects to pay my lawful debts particularly to sell out of the funds any sum of money that may be wanting to renew a lease of a house and repair the same situated in Piccadillo Westminster know by the name of the three Kings a Moiety of the same is in possession of my mother Elizabeth Rycaut widow which she is to enjoy during her natural life afterwards to revert to my two daughters Ann and Celia Rycaut or the longest liver wrote with my own Hand Writing Sealed with my own Seal in Dowry Square near the City of Bristol this 22nd day of June 1763

Having omitted to mention in the body of my Will to whom my money and effects are to revert to in case of the death of my two daughters now I do by these presents declare that in case of the death of my two daughters my will is that my money and effects be enjoyed by my dear mother Elizabeth Rycaut widow during her natural life then to my brother Major Paul Rycaut Given under my Hand in Dowry Square near the City of Bristol this 22 day of June 1763

Thomas by Divine Providence Archbishop of Canterbury Primate of all England and Metropolitan Do by these presents make known to all men that on the twenty sixth day of July in the year of our Lord one thousand seven hundred and sixty three at London before the Worshipful Andrew Coltee Ducarel Doctor of Laws Surrogate of the Right Worshipful Sir Edward Simpson Knight Doctor of Laws Master Keeper or Commissary of Our Prerogative Court of Canterbury lawfully constituted the Last Will and Testament with a Codicil of Edward Rycaut late of Portsmouth in the County of Southampton and a Lieutenant-Colonel of Marines Esquire deceased thereunto annex was proved approved and registered the said deceased having whilst living and at the time of his death goods chattels or credits in divers dioceses or Jurisdictions by reason whereof the proving and registering the said Will and the granting Administration of all and singular the said Goods Chattels and Credits and also the auditing allowing and final discharging the account thereof are well known to appertain only and wholly to us and not to any inferior Judge and that Administrations of all and singular the good chattels and credits of the said deceased and any way concerning his will was granted to Elizabeth Rycaut widow the mother and Paul Rycaut Esquire the brother of the said deceased and Executors named in the said Will he having been already sworn well and faithfully to administer the same and to make a true and perfect Inventory of all and singular the said Goods Chattels and Credits and to exhibit the same into the Registry of our said Court on or before the last Day of January next ensuing and also to render a just and true Account thereof given at the time and place above written and in the sixth year of our translation
