Indenture being a Lease for a year of a close or parcel of tillage land or
ground called the Upper Patch situate upon Howle Hill in the parish of Walford
in the County of Hereford dated 18 December 1822, Mr William Smith to Mr John
Harris

This Indenture made the
eighteenth day of December in the year of our Lord one thousand eight hundred
and twenty two Between William
Smith of Howl Hill in the parish of Walford in the county of Hereford
labourer of the one part and John Harris the younger of Howl Hill aforesaid
labourer of the other part Witnesseth
that the said William Smith for and in consideration of the sum of five
shillings of lawful British money to him in hand paid by the said John Harris
at or immediately before the sealing and delivery of these presents the
receipt whereof is hereby acknowledged Hath granted bargained and sold and by
these presents Doth grant bargain and sell unto the said John Harris his
executors administrators and assigns
All that close or parcel of tillage land or ground called the Upper Patch
situate upon Howl Hill in the parish of Walford aforesaid containing about
one statute acre and a quarter (be the same more or less) having a road or
way leading from Lidbrooke towards the Warren on the East land of James
Whiting on the West, land of John Whiting on the South and a road or way
leading towards Whitings Barn and Walford Mill on the North And which said
close or parcel of ground was enclosed by the said William Smith about thirty
years since out of a certain waste called Bishops Wood Together with all ways
waters watercourses timber and other trees hedges ditches mounds bounds
fences commons common of pasture profits privileges advantages emoluments
rights members and appurtenances whatsoever to the said close or parcel of
land or ground belonging or in any wise appertaining And the reversion and
reversions remainder and remainders rents issues and profits thereof To have and to hold the said close
or parcel of land or ground hereditaments and premises hereinbefore mentioned
and described and intended to be hereby granted bargained and sold with their
appurtenances unto the said John Harris his executors administrators and
assigns from the day next before the day of the date of these presents unto
the end and for and during the full term of one whole year thence next
ensuing and fully to be complete and ended Yielding and paying therefore unto the said William Smith his
heirs or assigns the rent of one peppercorn upon the Feast Day of Saint Michael
the Archangel now next ensuing if lawfully demanded To the intent and purpose
nevertheless that by virtue of these presents and by force of the statute
made and provided for transferring of uses into possession he the said John
Harris may be in the actual possession of the said close or parcel of land or
ground hereditaments and premises and be thereby enabled to accept and take a
grant and release of the reversion and inheritance thereof to him and his
heirs for ever To and for such use and uses as in and by such grant and
release shall be limited expressed and declared and to for or upon no other
use trust end intent or purpose whatsoever In witness whereof the said parties to these presents have
hereunto set their hands and seals the day and year first above written
