AFFIDAVIT DATED 4 AUGUST 1735

 

A paper document being an Affidavit of Hugh Hords dated 4 August 1735 regarding his son’s, Robert Hords, non-appearance at the Assizes in the matter of Our Sovereign Lord the King v Hugh Hords

The appearance of Robert Hords at the Assizes was to answer an indictment for compounding a petty larceny committed by Elizabeth Pugh in stealing a brass spoon of little value. The Affidavit states that Robert Hords is “… an Idle Extravagant man and contracting several debts ran away for fear of being arrested ….. heard he is absconded in or about the City of London …..” reading as follows:-

 

Hugh Hords of Wellington in the County of Hereford maketh oath that he this depont together with one Robert Harris (a servant of this deponts son Robert Hords late of Eardisly in this County) was at the last Epiphany .. Sessions Held for this County on reading of a Certificate from the Clerk of the Assize severally bound in a Recognizance of Five Pounds oath for the appearance of the said Robert Hords at the last Court Assizes held for this County to answer to an indictment prefored (?) against the said Robert at Lent Assizes in the Fourth year of His present Majesties reign for compounding a petty larceny said to be committed by Elizabeth the wife of Thomas Pugh of Eardisly in the said County in stealing a brass spoon of a small value And this depont sais that he this depont did accordingly appear but the said Robert Hords his son (for whose appearance he was bound) being an Idle Extravagant man and contracting several debts ran away for fear of being arrested and left his wife and children behind him (one of which this depont is obliged to maintain) And this depont sais that at the last Assize he was so far indulged as to have his Recognizance continued to this Assize in hopes of being able to bring his said son to appear at this Assize But this depont sais that notwithstanding he has used his endeavour to bring his said son in he has not been able to find out where he his but has heard he is absconded in or about the city of London And this depont further sais that he has but a small estate and that greatly incumbered with debt and that he is not well able to pay the said five pounds.
