LEASE
DATED 23 JULY 1839
A vellum Indenture
being a Lease of a year of land in the hamlet of Wotton St Mary near the City
but in the County of Gloucester, Messrs Thomas Smith and John Packwood to Mr
John Smith reading as follows:

This Indenture made the twenty third day of July
in the year of our Lord one thousand eight hundred and thirty nine Between
Thomas Smith of the city of Gloucester gentleman and John Packwood of
Cheltenham in the county of Gloucester gentleman of the one part and John
Smith of Barton Street in the city and Borough of Gloucester grocer of the
other part Witnesseth that for and in consideration of the sum of five
shillings of lawful money of Great Britain to the said Thomas Smith and John
Packwood in hand well and truly paid by the said John Smith at or immediately
before the sealing and delivery of these presents the receipt whereof is
hereby acknowledged They the said Thomas Smith and John Packwood Have
and each of them Hath bargained and sold And by these presents Do
and each of them Doth bargain and sell unto the said John Smith his
executors administrators and assigns All that piece or parcel of land
or ground situate lying and being in the Hamlet of Wotton St Mary near the
city but in the county of Gloucester containing by admeasurement thirty five
perches or thereabouts bounded on the north east by land lately sold by the
said Thomas Smith and John Packwood to
blank Meadows on the North West by the road leading from Barton Street to
Wotton and on all other parts by the remainder of the said piece of land of
which the said piece or parcel of land hereinbefore described is part and now
in the occupation of the said John Smith Together with all ways waters
watercourses hedges ditches trees mounds fences easements profits privileges
advantages and appurtenances whatsoever to the said piece or parcel of land
and hereditaments hereby bargained and sold belonging or appertaining And the
reversion and reversions remainder and remainders rents issues and profits
thereof To have and to hold the said piece or parcel of land and
hereditaments hereinbefore expressed to be hereby bargained and sold unto the
said John Smith his executors administrators and assigns from the day next
before the day of the date hereof for and during and unto the full end and
term of one whole year from thence next ensuing and fully to be complete and
ended Yielding and paying therefore unto the said Thomas Smith and
John Packwood their heirs and assigns the rent of one peppercorn on the last
day of the said term (if the same shall be lawfully demanded) To the
intent and purpose that by virtue of these presents and by force of the
statute made for transferring uses into possession he the said John Smith may
be in the actual possession of the said piece or parcel of land and
hereditaments and all and singular other the premises hereby bargained and
sold and be thereby enabled to accept and take a grant and release of the
freehold reversion and inheritance thereof unto him the said John Smith and
his heirs To for and upon such uses trusts intents and purposes as are
mentioned expressed and declared thereof in and by a certain Indenture of
release already prepared and intended to bear date the day next after the day
of the date of these presents and made between the said Thomas Smith and John
Packwood of the first part the said John Smith of the second part and James
Henry Dowling of the third part and to for or upon no other use trust intent
or purpose whatsoever In witness whereof the said parties to these
presents have hereunto set their hands and seals the day and year first above
written
