LEASE
DATED 19 DECEMBER 1823
A vellum
Indenture being a Lease for a year of a capital messuage or tenement situate in
Bear Lane otherwise East Stockwell Street in the parish of Saint Martin in
Colchester in the County of Essex dated 19 December 1823, Mrs Elizabeth Wigson
to Mr Thomas Catchpool junior reading as follows:

This Indenture made the
nineteenth day of December in the fourth year of the reign of our Sovereign
Lord George the Fourth by the Grace of God of the United Kingdom of Great
Britain and Ireland King Defender of the Faith and in the year of our Lord one
thousand eight hundred and twenty three Between Elizabeth Wigson of
Sible Hedingham in the county of Essex widow formerly Elizabeth Filto
spinster the niece and heiress at law of Elizabeth Seaber late of Colchester
in the said county widow deceased who died intestate and without issue The
said Elizabeth Wigson being the only child of John Filto and Anne his wife
both deceased and which said Anne Filto and Elizabeth Seaber were the two
only children of John Bacon and Mary his wife long since deceased of the one
part and Thomas Catchpool the younger of Colchester aforesaid ironmonger of
the other part Witnesseth that for and in consideration of the sum of
five shillings of lawful English money to the said Elizabeth Wigson in hand
well and truly paid by the said Thomas Catchpool at or before the sealing and
delivery of these presents the receipt whereof is hereby acknowledged She the
said Elizabeth Wigson Hath bargained and sold and by these presents Doth
bargain and sell unto the said Thomas Catchpool his executors
administrators and assigns All that capital messuage or tenement with
the houses outhouses yards gardens ways waters easements profits commodities
hereditaments and appurtenances whatsoever to the same belonging or in any
wise appertaining as the same are situate lying and being in the parish of
Saint Martin in Colchester aforesaid in a Street their called Bear Lane
otherwise East Stockwell Street and on the West side thereof abutting towards
the North on certain stables and premises belonging to blank Garnond
and towards the South on a messuage and premises belonging to William Chaplin
which said bargained and sold messuage and premises formerly were in the
tenure or occupation of Samuel Mortier since of William Smith deceased and
afterwards of William Smith his son since of the said Elizabeth Seaber then
of Captain Badderly late of Robert Latten or his assigns and are now empty To
have and to hold the said messuage or tenement hereditaments and all and
singular other the premises hereinbefore particularly mentioned and described
and hereby bargained and sold or intended so to be with their and every of
their rights members and appurtenances unto the said Thomas Catchpool his
executors administrators and assigns from the day next before the day of the
date of these presents for and during and unto the full end and term of one
whole year from thence next ensuing and fully to be compleat and ended Yielding
and paying therefore unto the said Elizabeth Wigson her heirs or assigns
the rent of one pepper corn only on the last day of the said term (if the
same shall be lawfully demanded) To the intent that by virtue of these
presents and of the statute made for transferring uses into possession the
said Thomas Catchpool may be in the actual possession of the said messuage or
tenement hereditaments and all and singular other the premises hereby
bargained and sold or intended so to be with their and every of their
appurtenances and may thereby be enabled to accept and take a Grant and
Release of the reversion and inheritance thereof to him and his heirs To such
uses upon and for such trusts ends intents and purposes as shall be expressed
and declared concerning the same in and by a certain Indenture of Release of
three parts already prepared and intended to bear date the day next after the
day of the date of these presents and to be made between the said Elizabeth
Wigson of the first part the said Thomas Catchpool of the second part and
James Barker therein described of the third part In witness whereof
the said parties to these presents have hereunto set their hands and seals
the day and year first above written
