Of the Will of Isaac Piper

Late of Toppesfield, deceased

This Is the Last Will and Testament of me Isaac Piper of Woodleys Farm in the parish of Toppesfield in the county of Essex farmer as follows First I give and devise unto my son James Piper and Daniel Dixon of Little Bardfield in the said county and their heirs All such part and parts and so much as is are or be freehold of and in All and every my messuages tenements lands and hereditaments situate and being in Toppesfield aforesaid or in any other parish or place thereto next or near adjoining now in my own occupation Upon Trust that they the said James Piper and Daniel Dixon or the survivor of them or his heirs do and shall as soon as conveniently may be after my decease sell and dispose of the same for the best price or prices that can or may be reasonably had or gotten for the same Also I do hereby authorise and impower my executors hereinafter named or the survivor of them his executors or administrators as soon as conveniently may be after my decease to sell and dispose of All such part and parts and so much as is are or be Copyhold or of Customary Tenure of and in All those the aforesaid messuages or tenements lands hereditaments and premises (the same being surrendered to the use of my Will) for the best price or prices that can or may be reasonably had or gotten for the same And I will and direct that the receipt or receipts of the said James Piper and Daniel Dixon or the survivor of them his heirs executors or administrators respectively shall be sufficient releases and discharges to the purchaser or purchasers of the said freehold and copyhold premises respectively for so much thereof for which such receipt or receipts shall be so given without such purchaser or purchasers being obliged to see to the application or being answerable for the misapplication or nonapplication of the purchase money or any part thereof And the monies to arise from such sale or sales as aforesaid I will shall be disposed of as hereinafter mentioned All my personal estate and effects be the same of what nature kind or quality soever and wheresoever (after payment of my just debts funeral expenses and the charge of proving this my Will) as also the monies to arise from the sale of my freehold and copyhold lands hereditaments and premises hereinbefore directed to be sold I give devise and bequeath unto such of my six children who shall be living at the time of my decease namely Sarah now the wife of John Stewart Isaac Joseph James Edward and Stephen Piper equally to be divided between or amongst them share and share alike And I do hereby nominate constitute and appoint my said son James Piper and the said Daniel Dixon executors of this my Will And my mind and will is that it shall and maybe lawful to and for my said executors and trustees and the survivor of them his heirs executors or administrators from time to time to deduct retain and reimburse to him and themselves respectively by and out of the monies which shall come to his or their hands respectively by virtue of this my Will all such loss costs damages and expenses as he they or any of them shall sustain bear pay expend or be put unto in and about touching or concerning the trusts hereby in them reposed or the management and execution thereof or any other thing in any wise relating thereto And that they any or either of them their or either of their heirs executors or administrators shall not be charged or chargeable with or for any sum or sums of money other than such as shall come to his or their respective hands by virtue of this my will their joining in any receipt or receipts for the sake of conformity notwithstanding nor with or for any loss which shall happen of the said Trust monies and premises or any part thereof so as the same happen without his or their wilful default or neglect nor the one of them for the other of them but each of them only for his and their own act deed receipt default or disbursement And hereby revoking making void and disannulling all former and other Wills by me at any time heretofore made I do declare this to be my last Will and Testament In witness whereof I the said Isaac Piper the testator have to the first sheet of this my last Will and Testament (the whole being contained in two sheets of paper wrote on one side only) set my hand and to this second and last sheet my hand and seal this twenty fifth day of May in the year of our Lord one thousand eight hundred and twenty four

Whereas Daniel Dixon one of the trustees and executors named in my last Will and Testament is dead and I am desirous of appointing John Eley of Hoses Farm in Toppesfield a trustee and executor in the room place and stead of the said Daniel Dixon deceased Now I do by this Codicil to my said Will which I wish to be considered and taken as part thereof give and devise All and singular the messuages lands and hereditaments mentioned in my said Will and devised to the said Daniel Dixon jointly with my son James Piper unto the said John Ely and James Piper their heirs and assigns upon the trusts and for the several intents and purposes mentioned and expressed in my said Will as fully and effectually as if the said John Ely had been originally named therein And I do hereby nominate constitute and appoint the said John Ely joint executor with my said son James Piper In witness whereof I the said Isaac Piper the testator have to this Codicil to my said last Will and Testament hereunto set my hand and seal this twenty eighth day of November in the year of our Lord one thousand eight hundred and twenty six
